Important: By creating an account or using REACH ChurchConnect, you agree to these Terms. If you are registering on behalf of a church or organization, you represent that you have authority to bind that organization to these Terms.
1 Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "Church Customer," or "User") and Reach Church MS, LLC ("REACH," "we," "our," or "us"), the operator of the REACH ChurchConnect platform ("Platform").
By accessing or using the Platform — including our mobile applications (iOS and Android), web application, and APIs — you confirm that:
- You have read and understood these Terms and our Privacy Policy
- You are at least 18 years of age
- You have the legal capacity and authority to enter into this agreement
- If registering on behalf of an organization, you are authorized to bind that organization
2 Description of Services
REACH ChurchConnect is a cloud-based church management system ("CMS") offered as a Software-as-a-Service (SaaS). The Platform includes, depending on your subscription tier:
- Member Management: Member database, family groups, attendance tracking, RBAC
- Online Giving: Donation processing via Stripe Connect, recurring giving, QR code giving, text-to-give
- Communications: SMS messaging, email campaigns, push notifications, in-app messaging
- Events: Event creation, registration, ticketing, volunteer management
- Multi-Campus: Multiple campus and service management
- AI Features: AI-powered follow-up suggestions, giving insights, attendance analytics
- Video: Live streaming and video meeting integration via Daily.co
- Reporting: Financial reports, giving statements, member reports, analytics dashboards
- Children's Ministry: Kids check-in kiosk, guardian management
We reserve the right to modify, suspend, or discontinue any feature of the Platform with reasonable notice. We will not materially reduce core platform functionality during a paid subscription period without offering a pro-rata refund or alternative.
3 Accounts & Registration
3.1 Account Creation
To use the Platform, you must register and create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
3.2 Account Security
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activity that occurs under your account
- You must immediately notify us of any unauthorized access or breach at security@reachchurchms.com
- We are not liable for losses caused by unauthorized account access resulting from your failure to maintain credentials securely
3.3 Organizational Accounts
Church Customer accounts may include multiple users with different permission levels (Admin, Staff, Member, etc.). The Church Customer is responsible for managing user access and ensuring all users comply with these Terms.
3.4 One Account Per Church
Each church or organization may register for one primary account. Multi-campus support allows multiple campus locations under a single account per our plan terms.
4 Subscription & Billing
4.1 Subscription Tiers
We offer the following subscription plans:

Plan features and limits may be updated. We will provide at least 30 days' notice before reducing limits on existing active subscriptions.
4.2 Billing & Payment
- Subscriptions are billed monthly or annually in advance
- Payment is processed by Stripe, our PCI-DSS compliant payment processor
- All fees are non-refundable except as expressly stated in these Terms or required by law
- Annual subscriptions are non-refundable after the 14-day cooling-off period
- We reserve the right to change pricing with 30 days' advance notice
- Price changes do not apply to active annual subscriptions until renewal
4.3 Free Trial
We may offer free trials at our discretion. At the end of a free trial, your account will automatically convert to the Free plan (or the paid plan you selected) unless you cancel. You will not be charged during a free trial.
4.4 Overages & Add-ons
If you exceed your plan's included limits (SMS, email, video minutes, AI requests), the Platform may send a usage alert. Resource add-ons are available for purchase to expand monthly limits. Overages without add-ons may result in service throttling, not automatic charges.
4.5 Cancellation
- You may cancel your subscription at any time from your account settings
- Upon cancellation, your account will remain active until the end of the current billing period
- After the billing period ends, your account will convert to Free plan limitations or be suspended
- Your data will be retained for 90 days after subscription end, after which it may be deleted
5 Acceptable Use Policy
You agree to use REACH ChurchConnect only for lawful purposes and in a manner consistent with all applicable laws and regulations. You must not:
5.1 Prohibited Activities
- Use the Platform to send unsolicited commercial messages (spam)
- Send SMS messages to individuals who have not consented or who have opted out
- Use the Platform for any illegal, harmful, fraudulent, or deceptive activity
- Attempt to gain unauthorized access to other accounts, systems, or networks
- Reverse-engineer, decompile, or disassemble any part of the Platform
- Use automated bots or scrapers to access the Platform
- Interfere with or disrupt Platform infrastructure, servers, or networks
- Upload viruses, malware, or any malicious code
- Impersonate any person or organization
- Use the Platform to discriminate against individuals based on protected characteristics
- Resell or sublicense access to the Platform without our prior written consent
5.2 Content Standards
All content you upload, post, or transmit through the Platform must not:
- Violate any applicable law, regulation, or third-party right
- Contain hate speech, harassment, or content that promotes violence
- Contain sexually explicit material or exploit minors in any way
- Constitute defamation, libel, or invasion of privacy
5.3 Consequences
Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund. We may also report violations to appropriate authorities.
6 Data Ownership & License
6.1 Your Data
You retain all ownership rights to the data you input into the Platform ("Customer Data"), including member information, financial records, and communications. You grant REACH a limited, non-exclusive, worldwide license to process your Customer Data solely to provide and improve the Services.
6.2 REACH as Data Processor
Where applicable under GDPR and similar laws, REACH acts as a data processor and you (the Church Customer) act as the data controller for your members' personal information. We process member data only on your instructions as described in our Privacy Policy.
6.3 Data Export
You may export your Customer Data at any time from the Platform. Upon request, we will provide a complete data export in a standard format (CSV/JSON) within 30 days. Data export may be requested at support@reachchurchms.com.
6.4 Aggregated & Anonymized Data
We may use aggregated, anonymized, de-identified data derived from your use of the Platform for analytics, benchmarking, and product improvement. This data will never identify you or your church by name.
7 Payment Processing (Stripe Connect)
7.1 Online Giving
REACH facilitates online donation collection through Stripe Connect, which enables direct payouts to your church's bank account. To use online giving features, you must:
- Create and connect a Stripe Express or Standard account
- Complete identity verification as required by Stripe and applicable law
- Agree to Stripe's Connected Account Agreement and Terms of Service
- Be a legitimate nonprofit, religious organization, or church
7.2 Transaction Fees
Standard Stripe payment processing fees apply to all donations (typically 2.9% + $0.30 per transaction for cards; ACH rates differ). REACH may charge an additional platform fee depending on your plan. These fees are clearly disclosed before activation.
7.3 Payouts
Donation funds are paid directly to your connected bank account by Stripe on their standard payout schedule. REACH does not hold donation funds on your behalf.
7.4 Refunds & Chargebacks
You are responsible for managing donation refund policies for your church. REACH provides tools to issue refunds through the Platform. Excessive chargebacks may result in Stripe restricting or terminating your connected account per Stripe's policies.
7.5 Tax Exemption & Receipts
REACH provides donation receipts and giving statements for your donors. You are responsible for determining and communicating your organization's tax-exempt status and ensuring receipts comply with applicable tax laws (e.g., IRS guidelines for charitable contributions). REACH does not provide tax or legal advice.
8 SMS & Messaging Compliance
Important: You are responsible for obtaining proper consent from all recipients before sending SMS messages through the Platform. Violations of messaging laws can result in significant fines and account suspension.
8.1 A2P 10DLC Registration
All commercial SMS messaging in the United States must comply with A2P 10DLC (Application-to-Person 10-Digit Long Code) requirements set by carriers and the CTIA. By using SMS features, you agree to:
- Register your messaging use case through our platform's TCR (The Campaign Registry) registration process
- Only send messages to recipients who have given explicit prior written consent
- Honor all opt-out requests (STOP) immediately and permanently
- Include opt-out instructions in all promotional messages
- Not send messages for purposes not disclosed at opt-in
8.2 Prohibited Message Content
You may not use our messaging services to send:
- SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco) to consumers
- Phishing or fraudulent messages
- Messages violating TCPA (Telephone Consumer Protection Act)
- Political campaign messages without proper registration
- Messages to individuals who have opted out
8.3 Messaging Costs
SMS messages are deducted from your monthly plan allotment. Additional SMS capacity is available via add-on purchases. Standard carrier message and data rates apply to recipients.
8.4 Liability for Messages
You are solely responsible for the content of all messages sent through the Platform under your account. REACH is not responsible for violations of messaging laws, regulations, or carrier policies caused by your message content or targeting.
9 Intellectual Property
9.1 REACH Intellectual Property
The Platform, including all software, code, designs, logos, trademarks, and content created by REACH, is owned by Reach Church MS, LLC and protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our prior written consent.
9.2 Your License to Use the Platform
Subject to these Terms and payment of applicable fees, REACH grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal church management purposes during your subscription period.
9.3 Feedback
If you provide suggestions, feedback, or ideas about the Platform, you grant REACH a non-exclusive, perpetual, irrevocable, royalty-free license to use and incorporate such feedback into our products and services without any obligation to compensate you.
10 Confidentiality
Each party agrees to keep the other party's confidential information strictly confidential, using the same degree of care it uses to protect its own confidential information (but no less than reasonable care). "Confidential Information" includes pricing, technical specifications, business plans, and any information marked as confidential.
Confidentiality obligations do not apply to information that: (a) is or becomes publicly known through no breach of this agreement; (b) was rightfully known before receipt; (c) is required to be disclosed by law or court order; or (d) is independently developed without use of confidential information.
11 Disclaimers & Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REACH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF ANY INFORMATION
- WARRANTIES THAT THE PLATFORM WILL MEET YOUR SPECIFIC REQUIREMENTS
REACH does not warrant that: (a) the Platform will meet your requirements; (b) the Platform will be available at all times; (c) defects will be corrected; or (d) the Platform is free of viruses or other harmful components.
We target 99.5% uptime but do not guarantee specific uptime levels. Planned maintenance will be communicated with at least 24 hours' notice where possible.
12 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- REACH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- THIS INCLUDES LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY
- REACH'S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO REACH IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100)
These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, etc.) and even if REACH has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
13 Indemnification
You agree to indemnify, defend, and hold harmless REACH, its officers, directors, employees, agents, and licensors from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Platform in violation of these Terms
- Your Customer Data or content transmitted through the Platform
- Your violation of any applicable law or regulation, including messaging compliance laws
- Your breach of any representation, warranty, or obligation in these Terms
- Any dispute between you and a third party, including your church members
14 Termination
14.1 Termination by You
You may terminate your account at any time by canceling your subscription in your account settings. Cancellation takes effect at the end of your current billing period.
14.2 Termination by REACH
We may suspend or terminate your account immediately, with or without notice, if:
- You violate these Terms or our Acceptable Use Policy
- You fail to pay subscription fees after 14 days' notice
- We are required to do so by law or a court order
- Your account poses a security risk to the Platform or other users
14.3 Effect of Termination
- Access to the Platform will cease upon account termination
- You must immediately cease using the Platform
- Your Customer Data will be retained for 90 days following termination, after which it may be permanently deleted
- You may request a data export before or during the 90-day retention period
- Financial records required for legal compliance will be retained per applicable law
- Provisions of these Terms that by their nature should survive termination will survive, including Sections 6, 9, 10, 11, 12, 13, and 15
15 Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the federal or state courts located in Texas, and you hereby consent to personal jurisdiction in such courts.
If you are a consumer located in the European Union, you may also have the right to bring a claim before the courts of your country of residence.
16 Dispute Resolution
16.1 Informal Resolution
Before initiating formal dispute proceedings, you agree to contact us at legal@reachchurchms.com and attempt to resolve the dispute informally for at least 30 days.
16.2 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Texas. The arbitrator's award shall be final and binding.
16.3 Class Action Waiver
YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ON AN INDIVIDUAL BASIS, NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive your right to participate in a class action lawsuit or class-wide arbitration.
16.4 Exceptions
Either party may seek injunctive or other equitable relief in any court of competent jurisdiction for claims involving intellectual property infringement, misappropriation of trade secrets, or violations that could cause irreparable harm.
17 Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes:
- We will notify you by email at least 30 days before the changes take effect
- We will post a notice in the Platform
- We will update the "Last Updated" date at the top of this page
Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must cancel your subscription and stop using the Platform before the effective date of the changes.
For minor, non-material changes (typographical corrections, clarifications), we may update these Terms without prior notice.
Entire Agreement
These Terms, together with our Privacy Policy and any additional agreements you sign with us (such as a Data Processing Addendum or Enterprise Agreement), constitute the entire agreement between you and REACH regarding the Platform and supersede all prior agreements, negotiations, and representations.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Waiver
REACH's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. A waiver of any right or provision must be in writing and signed by an authorized representative of REACH.
